At OpenBeds, we take the utmost care in protecting the privacy and integrity of your personal information. This OpenBeds User Privacy Notice (“Privacy Notice”) provides you with information about how we collect, use, and disclose your personal information.

About This Privacy Notice

The OpenBeds-TreatmentConnection, however accessed, including this public facing portal and any related mobile applications (collectively, “OpenBeds-TreatmentConnection” or the “site”) is provided by OpenBeds Inc. (“OpenBeds” or “we”), a company organized under the laws of Delaware, U.S.A.

This Privacy Notice describes the privacy practices of OpenBeds’ websites, applications (“apps”), and mobile platforms. Please read this Privacy Notice carefully to learn how we collect, use, share, and otherwise process personal information relating to individuals (“Personal Data”), and your rights and choices regarding our processing of your Personal Data.

This Privacy Notice applies to the following activities and circumstances:

  • Visiting the OpenBeds-TreatmentConnection site or any other OpenBeds websites, or using our web-based services, desktop apps, mobile apps, or mobile platforms which display or contain a link to this Privacy Notice, including registering for an account on any of these platforms;
  • Submitting Personal Data to OpenBeds-TreatmentConnection to inquire about services provided by third-party substance use disorder or mental health treatment providers (“Treatment Providers”);
  • Receiving communications from us, including emails, texts, phone calls, or faxes;
  • Requesting more information from OpenBeds about our products and services; andOther third parties with which you interact provide us with certain Personal Data about you.

This Privacy Notice does not apply to the activities of third parties such as Treatment Providers with which you interact through use of OpenBeds-TreatmentConnection, if Treatment Providers create their own websites, apps, or mobile platforms, where Treatment Providers may sell or offer their own products and services, when Treatment Providers send electronic communications to individuals, or where Treatment Providers collect and analyze Personal Data from individuals. The information practices of third-party services are governed by the third-party privacy statements, which we encourage you to review to better understand those privacy practices.

Types of Personal Data We Collect

Where OpenBeds collects Personal Data directly from you, we are the controller of your Personal Data and are responsible for the collection, processing, and disclosure of your Personal Data as described in this Privacy Notice. The Personal Data that we collect directly from you may include the following: contact information, registration information, device and usage information, as well as any other information type that we expressly ask you to enter and submit to any of our websites, apps, or mobile platforms:

Registration Information: If you register for OpenBeds-TreatmentConnection or any other apps or mobile platforms provided by OpenBeds, we will ask you to provide registration information, such as:

  • E-mail address;
  • A unique password;
  • Five-digit ZIP Code;
  • Birth Year;
  • Gender;
  • Substance use information; and
  • Health insurance status

Contact Information: If you express an interest in obtaining additional information about our products or services, request customer support, use our “Contact Us” or similar features, register to attend our seminars, webinars, or other presentations, register to use our websites, apps, or mobile platforms, or download certain content, we generally require you to provide us with your contact information, such as: your name, interest, phone number, email address, communications preferences, or username and password.

Device and Usage Information: If you use and interact with our websites, we may automatically collect device and usage information, through common information-gathering tools such as: log files and other information about your computer or mobile device and your usage of our websites through cookies, web beacons, or similar technologies, such as IP-addresses or other identifiers, which may qualify as Personal Data.

Collecting And Processing Your Personal Data Pursuant To Applicable Laws

We collect and process your Personal Data in a manner consistent with all requirements of the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”), the Health Information Technology for Economic and Clinical Health Act of 2009 (“HITECH”), and Title 42 of the Code of Federal Regulations Part 2: Confidentiality of Substance Use Disorder Patient Records (“Part 2 Regulations”). OpenBeds will never share your identifying personal information with Treatment Providers without your express consent.

Sharing Your Personal Data With Treatment Providers

By voluntarily submitting personal information to the OpenBeds-TreatmentConnection site, each User expressly authorizes OpenBeds to disclose the following non-identifying User information to such Treatment Providers selected by the User for the purposes of facilitating User’s referral for substance use or mental health treatment services:

  • Five-digit ZIP Code;
  • Birth Year;
  • Gender;
  • Substance Use Information
  • Health Insurance Status; and
  • The contents of any free text information provided by User in the comment section at registration.

OpenBeds will never share your name, e-mail address, or any other identifying personal information with Treatment Providers without your express consent.

As noted above, any free text information you voluntarily provide in the comment section during registration will be shared with Treatment Providers. When providing information in the comment section, you should take care to avoid sharing any identifying personal information that you would want to keep confidential.

Retention of Your Personal Data

OpenBeds may retain your Personal Data for a period of time, but only consistent with the original purpose of collection. We determine the appropriate retention period for Personal Data on the basis of the amount, nature, and sensitivity of your Personal Data, the potential risk of harm from unauthorized use or disclosure, and whether we can achieve the purposes of the processing through other means, as well as the applicable legal requirements (such as applicable statutes of limitation).

Upon the expiration of any retention periods, your Personal Data will be deleted in a manner conforming to any applicable state or federal laws regarding the disposal of such Personal Data. If there is any information that we are unable, for technical reasons, to delete entirely from our systems, including such information stored in any offsite or otherwise archival databases to which access is limited, we will put in place appropriate measures to prevent any further use of such Personal Data.

Children’s Privacy

OpenBeds websites, apps, and mobile platforms are not directed at minors, and individuals under the age of 18 are not permitted to use the OpenBeds-TreatmentConnection site. OpenBeds does not knowingly collect or process Personal Data from children under the age of 18.

Data Privacy And Security

OpenBeds implements a variety of data privacy and security measures, including organizational, technical, and physical measures, which are designed to protect the integrity, confidentiality, and availability of Personal Data. While we follow generally accepted standards to protect Personal Data, no method of storage or transmission can be totally secure. You are solely responsible for protecting your password, limiting access to your computer and mobile devices, and signing out of websites, apps, and mobile platforms after your sessions.

Changes To This Privacy Notice

OpenBeds will update this Privacy Notice from time to time to reflect changes in our practices, technology, legal requirements, and other factors. If we do, we will post the revised version here with an updated revision date. We encourage you to periodically review this Privacy Notice to stay informed about our collection, processing and sharing of your Personal Data.
